Application phase (valid for each tour year)

§ 1 Organiser
Moving Adventures Medien GmbH with its registered office in 80337 Munich, Thalkirchnerstr. 58 are organising a competition in which one winner will be selected by a jury.

§ 2 Access and duration
The invitation to tender is accessible exclusively via the Internet or the smartphone application at the following address: www.eoft.eu/unitedbysummits.

If the announcement or circumstances so require, the organiser reserves the right to postpone, modify, cancel or renew the prize draw. The promoter will not be held liable for any of these. The application phase will run up to and including 05.02. of a year. The winner(s) will be selected at the end of the competition. The winner(s) will be notified by e-mail or telephone using the details provided in the questionnaire.

§ 3 Participation
Participation in this competition is voluntary.

Participation in the Internet competition is free of charge and is reserved for persons of legal age (at least 18 years old at the time of participation) who have an e-mail address and a phone number, are resident in Europe and complete the questionnaire in full. Entries must be in English or German. No other form of entry is permitted.

Employees of Moving Adventures Medien, adidas TERREX and other companies involved in the organisation of the competition are not eligible to enter. Persons who have a professional relationship with a competitor of the promoter or adidas TERREX, whether through employment, sponsorship, endorsement or otherwise, are not eligible to enter.

Participation in the competition constitutes acknowledgement and acceptance of these rules and terms and conditions.

No purchase or payment is required to enter or win. A purchase or payment does not increase the likelihood of winning.

Entries not made through eoft.eu/unitedbysummits will not be accepted. Incomplete entries are void and will not be accepted. If any of the participants's first and last name details are missing or incorrect, the entry will be disqualified from entry and will not be judged. The participant bears the burden of proof for the correctness and validity of the information provided by him/her. Only one participation per person is possible. If a person participates more than once, only the first participation will be taken into account.

§ 4 Rules of conduct
Participants may not use the competition for the expression of political or religious ideas.

Entries must not violate any applicable law or regulation or the rights of any third party or incite, advocate or express pornography, obscenity, indecency, hatred, bigotry, racism or gratuitous violence. Entries must not in any way be likely to cause damage to the promoter, adidas AG or its affiliates, agents and/or brands of adidas (or any other brands of the promoter).

Participants may not upload, post, email or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the use of any software or facilities on the website or app.

The promoter reserves the right to exclude any participant from the competition and to remove any entry from the website or the app if it does not comply with these rules of conduct or otherwise constitutes a breach of the terms and conditions.

§ 5 Competititon Principle
Participants must submit a project via www.eoft.eu/unitedbysummits in the questionnaire until 05 February of a year. If necessary, Moving Adventures Medien GmbH will contact you by e-mail or telephone regarding the submitted project. A jury will select the winning project by 28.02. of a year.

§ 6 Determination of the winning project
The prize will be awarded once to all participants. The selection will be made by a jury of three parties who will choose the project they consider the best from all the projects submitted for a joint realisation of the project within the framework of the activation during the European Outdoor Film Tour. The selection will be based on criteria such as feasibility, project status, fit of the project with the brand identity of the EOFT as well as adidas TERREX.

A pre-selection of the projects will be made by Moving Adventures Medien GmbH. Moving Adventures Medien GmbH reserves the right to contact individuals who have made it into the shortlist in order to clarify any queries regarding the submission or, if necessary, to make joint adjustments. The changes agreed upon there or the answers to the queries will update the submitted project of the participants without written confirmation.

A jury consisting of a representative of Moving Adventures Medien GmbH, a representative of adidas AG and a film expert (Producer) will then select the winning project from the shortlist. The decisions of the jury are final and binding. The points or rankings awarded by the jury will not be published.

The winner will be notified by email or phone no later than 28 February of a year. The name of the winner can be announced on the EOFT website or on Facebook and Instagram. The winner must contact Moving Adventures Medien by email or phone no later than 5 days after being notified of the prize, otherwise the prize will be forfeited and may be passed on to another person. The prize may also be forfeited or passed on by the jury if the points stated in the submitted application are not met (e.g. changed time frame, incorrect information on skills/feasibility/personal details, ...) or want to be changed.

By accepting the prize, the winner agrees to abide by the rules and regulations of the competition and the entire terms and conditions of participation, as well as to accept a supplementary agreement with adidas AG.

§ 7 Prize
The prize offers the opportunity to tell your own Summit story at EOFT as part of the adidas TERREX United By Summits campaign with the European Outdoor Film Tour together with Moving Adventures Medien GmbH. This will be done through videographic supervision and editing of the submitted project after filmic consultation. Moving Adventures Medien reserves the right to decide to what extent the resulting film will be visible in the EOFT programme.

Further support from adidas AG in the form of financial or in-kind support is possible to realise the project. This requires a written agreement between adidas and the winner. The winner is responsible for obtaining all necessary permits, clearances and approvals for the project (e.g. visa, passport, travel insurance, etc.). Certain conditions are attached to the acceptance of the prize, including but not limited to the signing of standard terms and conditions for participation in promotional campaigns and a liability release. The amount and form of Summit support is at the sole discretion of the Promoter in agreement with adidas AG and will be determined in writing and presented to the winner(s) for acceptance (Summit Support Confirmation).

Participants cannot derive any rights from their participation and do not have the right to claim payment or other remuneration for their entry or participation.

§ 8 Handing over of the prizes
The winner will receive support in the implementation of the submitted project. A prize cannot be exchanged for other prizes, other services of equal or lesser economic value or cash. The prize is personal and project-related and cannot be transferred to another person or to other projects. The organisers reserve the right, due to force majeure or reasons beyond their control, to change the nature of the prize used during the course of the competition or to replace the prize with other prizes of equal value. Such substitution may not result in an exchange or refund. The personal data provided as part of this competition will be treated confidentially in accordance with the German Data Protection Act.

§ 9 Due diligence
All entries may be subject to additional verification and due diligence as part of the judging process, including, but not limited to, providing proof of eligibility and confirmation that there are no restrictions that would limit or prohibit participation in the campaign.

By entering the contest, participants agree to sign all documents and provide all information necessary to complete the above checks and due diligence. Participants who fail to provide the required information or sign the required documents will lose their eligibility and may be excluded from further participation.

Participants who fail to participate in the verification and due diligence process or who fail to provide all required information in a timely manner and in the format communicated to participants will lose their eligibility and may be excluded from further participation. All notifications of these requirements will be made by email. A winner must respond to the prize notification by email within 5 days of being notified in accordance with the above clause, after which time the right to claim a prize may no longer be exercised.

§ 10 Liability and applicable law
Legal recourse is excluded. The liability of adidas TERREX is limited exclusively to the value of the project realisation. Moving Adventures Medien cannot be held liable for possible disruptions of the Internet or the corresponding links that occur due to unauthorised access to data or unlawful actions that in turn cause disruptions to the administrative process, security and order of the competition. Moving Adventures Medien shall also not be liable for any errors, omissions, interruptions, deletions or loss of e-mails. Moving Adventures Medien also cannot be held liable for internet congestion, the quality of internet users' equipment, nor the quality of the Internet connection and resulting delays in transmission. These terms and conditions are written in German. German law shall apply. The place of jurisdiction is Munich.

§11 Intellectual property
By entering this competition, participants agree that the following intellectual property rights in and to the material contained in any entry (material) are, to the fullest extent permitted by law, exclusively vested in the promoter:

a. the right to publish, reproduce and make publicly available the material; and

b. the right to modify the material in order to publish, reproduce or make it available to the public; and

c. to pass on to adidas AG .

Participants agree to assign or cause to be assigned to the promoter all such right, title and interest in and to such intellectual property rights. Participants further agree that they will execute (cause to be executed) all documents evidencing such transfer and perform (cause to be performed) all acts necessary for that purpose.

  1. Without prejudice to the generality of the foregoing, participants acknowledge and agree that the promoter (or such other entity as the promoter may designate) may (and the promoter shall have no obligation to) use, reproduce, adapt, translate, digitise, publish, revise, disclose, modify, transmit or otherwise exploit any submissions at any time in connection with any EOFT or adidas product or otherwise.
  2. Participants shall not be entitled to any compensation for the transfer of rights or use of any entry under these terms and conditions.
  3. By entering the competition, participants grant to the promoter the free use of participants' names, photographs, images, videos or sound recordings and their general locations for publication and communication purposes in relation to the competition for as long as necessary for the organisation and promotional purposes of this competition. To this end, participants agree that the grant of rights extends to any and all support and media, whether existing or developed in the future. This includes but is not limited to the following examples: Promotional materials, films, cinema, newspapers, TV, magazines and books (both paper and electronic) and the internet (including other websites, web casts, multimedia links and social networking sites).
  4. By entering the competition, participants unconditionally and irrevocably waive, to the fullest extent permitted by law, all moral rights in or relating to the work of the entry. Without limiting the foregoing, each participant agrees and represents that neither the promoter nor any other company shall be obliged to identify the participant as the author of the work unless required by law.
  5. By entering this competition, participants confirm and warrant that all work included in their entry is their own original work and does not constitute copying or include work of any third party and that the use of their entry by the promoter or any of its affiliates does not infringe the rights of any third party, including without limitation copyright, trade mark rights, design rights, privacy rights and publicity rights. By entering this competition, participants agree to indemnify and hold harmless the promoter, its affiliates, officers, directors, employees, agents, licensees and customers from and against any claim or demand (including reasonable legal fees) by any third party relating to the use of such work, submission and/or material by the promoter, its affiliates and licensees or arising out of any failure by the participant to comply with its obligations under these terms and conditions.
  6. By entering the competition, participants agree to provide any additional information in relation to the entry if requested by the promoter.
  7. By entering the competition, participants agree that if they are selected as a winner, they must grant Moving Adventures Medien further rights to use their name, likeness and image in any media in connection with the prize and agree the rights of us with adidas AG in a separate contract.
  8. By entering the competition, participants acknowledge (i) that the promoter and adidas AG has extensive access to ideas, stories, concepts and other materials and that new ideas are regularly submitted to the promoter and adidas AG from a variety of sources or developed by the promoter's own staff; (ii) that many of these ideas, stories, concepts or other materials may be competitive with, similar to or identical to the entries submitted to the competition; (iii) participants are not entitled to any compensation for any loss or damage suffered as a result of the entry: inside shall not be entitled to any compensation for the use by the promoter of similar or identical material; and (iv) the promoter shall have no obligation or liability whatsoever, direct or indirect, vicarious, contributory or otherwise, now or in the future, in respect of the infringement or protection of copyright in and to the entries submitted.
